in the proceedings concerning the constitutional legitimacy of Article 9-ter of Legislative Decree No. 78 of 19 June 2015 (Urgent provisions concerning local authorities. Provisions to ensure the continuity of security and territorial control devices. Rationalization of National Health Service expenditure and provisions concerning waste and industrial emissions), converted, with amendments, into Law No. 125 of 6 August 2015, brought by orders of 24 and 30 November 2023 by the Regional Administrative Court for Lazio, third quater section, registered at numbers 165, 167, 168, 169 and 170 of 2023 and at numbers 38, 39, 40, 41, 42, 43, 44, 45, 46, 47 and 48 of 2024 and published in the Official Gazette of the Republic, numbers 2, 3, 12 and 13, first special series, of the year 2024.

Having considered the pleadings of Siemens Healthcare srl, Integra LifeSciences Italy srl, Crossmed spa, Smiths Medical Italia srl, ICU Medical Europe srl and ICU Medical Italia srl, Therakos (UK) Limited, Miltenyi Biotec srl, Boston Scientific spa, Confindustria Dispositivi Medici – National Federation of Companies Operating in the Medical Devices and Biomedical Technologies Sectors, Roche Diagnostics spa, Aesse Chirurgica srl, DiaSorin spa and DiaSorin Italia spa with sole shareholder, Diatek srl, Alcon Italia spa, HS – Hospital Service spa, Ab Sciex srl, Samo Biomedica srl, Servizi Ospedalieri spa, Acilia H.S. srl, Hollister spa, Thermo Fisher Diagnostics spa, Bracco Imaging spa and the Tuscany Region; as well as the interventions of Medtronic Italia spa, FRL Medical Service srl, Instrumentation Laboratory spa and Med-El Elektromedizinische Geraete Gmbh – Italian Local Unit, Buhlmann Italia srl and the President of the Council of Ministers;

Rationalization of National Health Service expenditure and provisions concerning waste and industrial emissions), converted, with amendments, into Law No. 125 of 6 August 2015, with reference to Articles 3, 23, 41 and 117, first paragraph, of the Constitution, the latter in relation to Article 1 of the Additional Protocol to the European Convention on Human Rights.

Therefore

THE CONSTITUTIONAL COURT

having joined the cases,

declares unfounded, as regards the four-year period 2015-2018, the questions of constitutional legitimacy of Article 9-ter of Legislative Decree No. 78 of 19 June 2015 (Urgent provisions concerning local authorities. Provisions to ensure the continuity of security and territorial control devices. Rationalization of National Health Service expenditure and provisions concerning waste and industrial emissions), converted, with amendments, into Law No. 125 of 6 August 2015, raised, with reference to Articles 3, 23, 41 and 117, first paragraph, of the Constitution, the latter in relation to Article 1 of the Additional Protocol to the European Convention on Human Rights, by the Regional Administrative Court for Lazio, third quater section, with the orders indicated in the heading.
