Abstract
The paper addresses the issue of vaccination
coverage through an analysis of the solutions offered by the Government with
the decree law no. 73/2017 containing urgent provisions on vaccine prevention.
After a review of the main regulatory contents, the author deals with some
methodological issues - particularly related to the choice of this legislative
tool - such as the resort to decree law (instead of ordinary legislative
procedure), or its compliance with articles 32, paragraph 2, and 77 of the
Constitution.

Abstract
The present contribution analyses fundamental
rights of migrants and immigrants. First, the Author defines the concept of
fundamental rights, offering an analysis that deals with theory and case law on
that issue. Second, these rights are considered in the light of the Italian
constitutional system and of the structure of the Italian Constitution. Third,
the present works considers the position of immigrants and their relationship
with the territory. In conclusion, the Author highlights the need to reconsider
thoroughly the relationship between fundamental rights, equality and solidarity
principles, on the one hand, and the duty to be loyal to the Republic, on the
other hand.

Abstract
In occasione di due pronunce della Corte
costituzionale (i.e. 133 e 140 del 2017) – entrambe omogeneamente riconducibili
al tema “finanziario”, in quanto aventi ad oggetto le leggi di stabilità del
2016 dello Stato e della Regione siciliana – si è ritenuto di argomentare
intorno all’opinabile definizione del thema decidendum nonché intorno alla – altrettanto opinabile –
coerenza fra gli elementi dedotti (e valutati) dal suddetto thema.
Ciò perché in entrambi i casi pare emergere una sostanziale irrazionalità del
sindacato, determinata o da una incongrua sussunzione del raccordo ermeneutico
fra oggetto e parametro, nel primo, o dalla apoditticità della motivazione, nel
secondo, in apparente controtendenza rispetto alla logica “sistematica” che
dovrebbe invece connotare lo scrutinio di costituzionalità. Premessa la
consapevolezza della “flessibilità” di alcune norme di rito, l’impressione che
si ricava è di due decisioni infatti contraddistinte da un orizzonte analitico
alquanto limitato, in ragione o delle scelte processuali fatte dalle parti o di
una delimitazione delle questioni tale da non indurre la Corte ad una
valutazione ampia ed, appunto, “di sistema” dei temi sottesi alle medesime. In
tal senso, la capacità di muoversi fra le maglie del processo costituzionale
sembra essere assurta al ruolo di “arte”: la abilità non soltanto di fare la
domanda giusta ma, soprattutto, di porgerla in termini corretti; ovverosia in
modo tale da consentire – ad un Giudice naturalmente capace di pronunce di
ampio respiro – di sussumere, dalla singola fattispecie, una regola di portata
generale e di natura “ordinamentale” (R.D.M.).

Abstract
After analysing the evolution of the notion of
self-defence and the regional legislative interventions in the field of legal
aid, the contribution deals with decision no. 81 of 2017, whereby the
Constitutional Court declared the illegitimacy of the rule of the Veneto Region
which provided for free legal aid for resident citizens accused of excessive
self-defence.

Abstract
The essay examines the effects of the ECtHR’s
judgments on domestic judgments (not in criminal matters) that do not comply
with the supranational court’s rulings. Starting from decision no. 49 of 2015,
in which the Constitutional Court deemed necessary a judicial remedy capable of
removing the effects of domestic judgments breaching the ECHR, the author
critically examines the new consequences of the most recent decision of the
Constitutional Court no. 123 of 2017.

Abstract
The virtual community and the real community no longer
constitute parallel and independent worlds. Today, both produce daily
relationships between the various members, capable to generate potential
conflicts of interest in the selection procedures. However, according to the
Administrative Court of Sardegna, in the sentence 3rd
may 2017, n. 281, Facebook represents a simple means of communication, not a
new virtual square within which the members, who interact with each other, can
form links, damaging the impartiality of the public administration.

Abstract
The author, starting from a decision of the
Court of Cassation on the issue of kirpan for Sikh Indians, questions the
maximization of the protection of constitutionally protected assets (in this
case religious freedom and security) and the absence of a conciliatory solution
among the fundamental values at stake, finally identifying a way that can
reconcile the conflicting constitutional values.
