JUDGMENT
in the proceedings concerning the constitutional legitimacy of Article 17, paragraph 1, of Decree-Law No. 104 of 10 August 2023 (Urgent provisions for the protection of users, concerning economic and financial activities and strategic investments), converted, with amendments, into Law No. 136 of 9 October 2023, brought by the Regions of Veneto, Piedmont and Campania, with appeals served on 7 December 2023, and filed with the Registry on 7, 11 and 14 December 2023 respectively, entered at numbers 32, 33 and 34 of the Register of Appeals 2023 and published in the Official Gazette of the Republic, Special Series No. 52 of 2023 and No. 1 of 2024.
Having considered the pleadings of the President of the Council of Ministers;
having heard at the public hearing of 17 April 2024 the Reporting Judge Antonella Sciarrone Alibrandi;
having heard the lawyers Mario Bertolissi for the Regions of Veneto and Piedmont, Almerina Bove for the Region of Campania and the State Attorney Marco Corsini for the President of the Council of Ministers;
having deliberated in the deliberation chamber on 9 May 2024.
Held as to the facts
1. – By appeal filed on 7 December 2023 and entered at No. 32 of the Register of Appeals 2023, the Veneto Region challenged Article 17, paragraph 1, of Decree-Law No. 104 of 10 August 2023 (Urgent provisions for the protection of users, concerning economic and financial activities and strategic investments), converted, with amendments, into Law No. 136 of 9 October 2023, in reference to Articles 2, 3, first paragraph, 5, 97, second paragraph, 81, third paragraph, 117, third and fourth paragraphs, 118 and 119 of the Constitution.

THE CONSTITUTIONAL COURT
having joined the proceedings,
1) declares inadmissible the questions of constitutional legitimacy of Article 17, paragraph 1, of Decree-Law No. 104 of 10 August 2023, converted, with amendments, into Law No. 136 of 9 October 2023, raised, in reference to Articles 2 and 5 of the Constitution, by the Regions of Veneto and Piedmont, with appeals entered at numbers 32 and 33 of the Register of Appeals 2023;
